Zira bir hakkın, başkasının katılımı ile kullanılması mecburiyeti insanın özgür tabiatına ve ihtiraslarına uygun düşmemektedir. Bundan dolayı, müşterek mülkiyetın sürekliliğini gerekli kılan özel bir sebep yoksa genellikle müşterek hak sahipliği rejiminden bireysel hak sahipliği rejimine geçiş tercih edilmektedir. Bu geçişin teknik ve usulüyle ilgili temel kurallar, klasik fıkıh doktrininde kısmet 1 taksim başlığı altında ele alınmıştır. Taksim, müşterek mülkiyetın sona erdirilmesi ve paydaşlardan her birinin kendi hissesi üzerinde bağımsız olarak dilediği şekilde tasarruf etmesi amacına yönelik hukuki bir işlemdir. Bu taksim işlemi, genellikle ya mahkeme kararı 1 kazai olarak hükmen ya da taraflar arası rızaen 1 anlaşmayla gerçekle- şir. Müşterek mülkiyetın saniandıniması ise ya "aynen" ya "muhayee"ya da"bedel" karşılığında olur. Ülkemizde müşterek mülkiyetın taksimi konusu önemli bir yer iş gal etmektedir. Pek çok bölgede müşterek mülkiyetın muhdesat (üst) hakkının taksimi konusunda ciddi problemler yaşanmaktadır. İslam fıkıh doktrininde müşterek mülkiyetin taksimi konusunda yapılan çalışmalar da oldukça sınırlıdır. Müşterek mülkiyete konu olan arazilerin taksiminde muhdesat (üst araziye ait olur) hakkının durumuyla ilgili İslam fıkıh doktrininde yapılan düzenlernelerin neler olduğu hep merak konusu olmuştur. Bu nedenle "müşterek mülkiyet" kapsamındaki (iştirak veya müşterek) arazilerin taksimi ve muhdesatlarının durumu ile ilgili bir çalışma yapılması hedeflenmiştir.

TRT repertuarında bulunmayan bu marşın, günümüz Türkçe'sine ve Geleneksel Türk Sanat Müziği repertuarına kazandırılması, çalışmanın amaçlarındandır. Araştırmanın problemini, söz konusu niarşta kullanılmış olan "Neva'da Rast" makamının günümüzdeki tanımıyla, yayınlandığı dönemdeki kullanım biçimi arasındaki fark oluşturmaktadır. Anadolu'ya gelen müslüman Türkler, tasavvufun buralarda da yayılmasını sağlamışlar ve kısa zamanda eski tarîkatlarının tekkelerini ve çeşitli kollarını kurarak fethedilen her yere ulaştırmışlardır. Anadolu'daki bu gelişmelere paralel olarak tekke edebiyatı da aynı şekilde gelişmiştir. Tekkelerde yetişen şâirler, kalabalık halk topluluklarına hitabederek, sâde ve güzel bir dille şiir ve ilâhîler söylemişlerdir. Böylece Anadolu'da da, zengin ve kuvvetli bir dînî tasavvufî edebiyet kurulmuştur. Bu edebiyatın Anadolu'da kuruluşunun öncüleri, Orta-Asya'dan gelen dervişlerdir. Bunlar, Ahmed-i Yesevî'nin ve diğer Yesevî şâirlerin Türkçe şiir ve ilâhîlerini de getirmişlerdir. Zamanla Anadolu'da da, Orta-Asya'dakilere benzer şâirler ortaya çıkmışlardır. Bunların ilk temsilcileri Ahmed-i Fakîh (h. VII-VIII y.y./m. XIII-XIV. y.y.) Şeyyâd Hamza (h. VII/m. XIII. y.y.) ve Yûnus Emre (öl.: 720/1320 ?) gibi sûfî şâirleri bu edebiyatımızın kuvvetli şâirledir.

Zira bir hakkın, başkasının katılımı ile kullanılması mecburiyeti insanın özgür tabiatına ve ihtiraslarına uygun düşmemektedir. Bundan dolayı, müşterek mülkiyetın sürekliliğini gerekli kılan özel bir sebep yoksa genellikle müşterek hak sahipliği rejiminden bireysel hak sahipliği rejimine geçiş tercih edilmektedir. Bu geçişin teknik ve usulüyle ilgili temel kurallar, klasik fıkıh doktrininde kısmet 1 taksim başlığı altında ele alınmıştır. Taksim, müşterek mülkiyetın sona erdirilmesi ve paydaşlardan her birinin kendi hissesi üzerinde bağımsız olarak dilediği şekilde tasarruf etmesi amacına yönelik hukuki bir işlemdir. Bu taksim işlemi, genellikle ya mahkeme kararı 1 kazai olarak hükmen ya da taraflar arası rızaen 1 anlaşmayla gerçekle- şir. Müşterek mülkiyetın saniandıniması ise ya "aynen" ya "muhayee"ya da"bedel" karşılığında olur. Ülkemizde müşterek mülkiyetın taksimi konusu önemli bir yer iş gal etmektedir. Pek çok bölgede müşterek mülkiyetın muhdesat (üst) hakkının taksimi konusunda ciddi problemler yaşanmaktadır. İslam fıkıh doktrininde müşterek mülkiyetin taksimi konusunda yapılan çalışmalar da oldukça sınırlıdır. Müşterek mülkiyete konu olan arazilerin taksiminde muhdesat (üst araziye ait olur) hakkının durumuyla ilgili İslam fıkıh doktrininde yapılan düzenlernelerin neler olduğu hep merak konusu olmuştur. Bu nedenle "müşterek mülkiyet" kapsamındaki (iştirak veya müşterek) arazilerin taksimi ve muhdesatlarının durumu ile ilgili bir çalışma yapılması hedeflenmiştir.

Böylece Anadolu'da da, zengin ve kuvvetli bir dînî tasavvufî edebiyet kurulmuştur. Bu edebiyatın Anadolu'da kuruluşunun öncüleri, Orta-Asya'dan gelen dervişlerdir. Bunlar, Ahmed-i Yesevî'nin ve diğer Yesevî şâirlerin Türkçe şiir ve ilâhîlerini de getirmişlerdir. Zamanla Anadolu'da da, Orta-Asya'dakilere benzer şâirler ortaya çıkmışlardır. Bunların ilk temsilcileri Ahmed-i Fakîh (h. VII-VIII y.y./m. XIII-XIV. y.y.) Şeyyâd Hamza (h. VII/m. XIII. y.y.) ve Yûnus Emre (öl.: 720/1320 ?) gibi sûfî şâirleri bu edebiyatımızın kuvvetli şâirledir.
