Derechos y Políticas Ambientales en Andalucía segundo semestre

This study aims to analyze the recent Law 8/2018, of October 8, on Measures against Climate Change and for the Transition towards a new energy model in Andalusia, in order to consider the legal system it establishes and its meaning, both for the environmental law of the Autonomous Community and for the relation to law of the State on climate change, in line with the demands of the European Union and the international context. Thus, the involvement of public and private subjects in the fight against climate change, the combined mitigation and adaptation strategies provided for in the standard are considered, as well as the legal instruments created for this purpose.

The article provides an overview of the Spanish legal system in terms of climate change legislation and the regulatory framework of the so-called energy transition. The configuration of the Spanish State as decentralised makes it necessary to allow the Autonomous Communities, as infra-state entities, to develop their own policy to fight climate change. The article thus explores the opportunity and advisability of adopting a multilevel model of relations between the State and the Autonomous Communities, in accordance with the European Union’s climate neutrality requirements, and one that goes beyond the usual model of limited inter-administrative relations, based on the principle of coordination. First, the article deals with the basic State legislation on climate change and energy transition, with the aim of evidencing that the Autonomous Communities are necessary actors for the development and implementation of this framework. Second, it aims to provide an overview of what has been done so far by the Autonomous Communities. The article concludes with various reflections on the effectiveness of this decentralised model, insisting that its application is undeniable given that mitigation and adaptation actions have a territorial component that legitimises the intervention of infra-state entities. This Paper seeks, based on the undeniable relationship between health protection and the fight against climate change, the analysis of the public health model established in our climate legal system based on the actions of the Autonomous Communities. For this, the Law 7/2021, of May 20, on Climate Change and Energy Transition, as a legal framework, must be considered, as well as the different legal situation of the Autonomous Communities, depending on whether they have legislated or not in this matter. Thus, the Paper concludes with some reflections about the effectiveness of a model based on heterogeneous actions of the mentioned Autonomous Communities regarding public health and climate change.

La Crónica de este semestre abarca el período comprendido entre noviembre de 2017 y abril de 2018. En dicho período, la Comunidad Autónoma se mantiene en línea de continuidad con la acción normativa de Andalucía en el último año, esto es, una actividad reguladora moderada, en la que no hay leyes (o normas con rango de Ley) de contenido ambiental, y sí una regulación más intensa en el nivel de Decretos y Órdenes, tal y como iremos poniendo de manifiesto.

El trabajo que se presenta pretende ser un estudio de la ordenación jurídica de las energías renovables actual teniendo en cuenta la dirección de futuro que este sector debe tomar, tanto por la incidencia de las corrientes liberalizadoras provenientes de Europa, como por la nueva regulación del sector a partir de la Directiva 2009/28/CE, del Parlamento y del Consejo, de 23 de abril, de fomento de las energías renovables. En este sentido, el aprovechamiento eólico y la regulación más reciente de esta materia por las Comunidades Autónomas plantea un escenario idóneo para la reflexión, teniendo en cuenta el papel de las normas ambientales como límite a la liberalización del ejercicio de la actividad económica.
