La norma recoge un primer paquete de medidas dirigidas a avanzar en el reforzamiento financiero del sistema y contener el incremento de gastos aparejado a la inminente jubilación de los «baby boomers». Con el fin de alinear progresivamente la edad real de jubilación a la edad legal se modifica el régimen jurídico de la jubilación anticipada. Paralelamente, la norma busca promover el mantenimiento de la vida activa, implementando para ello mejoras que conciernen a la jubilación postergada (se amplía el abanico de incentivos posibles), la jubilación activa, y las cláusulas de jubilación forzosa establecidas en los convenios colectivos. Law 21/2021, of December 28, guaranteeing the purchasing power of pensions and other measures to reinforce the financial sustainability of the public pension system, incorporates significant changes in the field of retirement pension. The regulation includes a first package of measures aimed at advancing in the financial strengthening of the system and containing the increase in expenses linked to the imminent retirement of the «baby boomers». In order to progressively align the actual retirement age to the legal age, the legal regime for early retirement is modified. At the same time, the regulation seeks to promote the maintenance of an active life, implementing improvements that concern delayed retirement (the range of possible incentives is expanded), active retirement, and the forced retirement clauses established in collective agreements.

En concreto, respecto a la responsabilidad que las empresas europeas, o aquellas que operan en Europa, deben asumir en materia de diligencia debida en las cadenas de valor, así como en relación a la información que las empresas ponen en el mercado en relación a la atención y actividad que desarrollan en materia de sostenibilidad, entendiendo este concepto en un sentido amplio, ambiental, pero también laboral y de gobernanza. El presente estudio analiza dicho marco normativo, asistemático y disperso, agrupándolo en los dos grandes conceptos que lo caracterizan, esto es, el incremento de las obligaciones empresariales en materia de trabajo digno, y una mayor transparencia en relación a las condiciones laborales. Todo el conjunto genera el efecto de una ampliación de la protección clásica dispensada por el Derecho del Trabajo, hacia formas de prestación de servicios fuera de sus fronteras, y hacia territorios que exceden de los límites de la Unión Europea. The EU expresses a growing interest in generating an innovative regulatory framework in terms of sustainable business management linked to decent and fair work. Specifically, regarding the responsibility that European companies, or those that operate in Europe, must assume in terms of due diligence in value chains, as well as relative to the information that companies place on the market in relation to the attention and activity that they develop in terms of sustainability, understanding this concept in a broad, environmental sense, but also labor and governance. This study analyzes this unsystematic and dispersed regulatory framework, grouping it into the two main concepts that characterize it, that is, the increase in business obligations in terms of decent work, and more transparency in relation to working conditions. The whole set generates the effect of an extension of the classic protection provided by labor law, towards forms of provision of services outside its borders, and towards territories that exceed the limits of the European Union.

Tomando como referencia la doctrina fijada por el TJUE, el análisis se centra en las interpretaciones que los tribunales administrativos de recursos contractuales han ido marcando en sus resoluciones respecto a la dimensión cualitativa y cuantitativa de los criterios de adjudicación. This study analyzes the interpretive difficulties that the inclusion of social criteria in the contract award phase has raised, especially those related to the necessary link with its object. Taking as a reference the doctrine established by the CJEU, the analysis focuses on the interpretations that the administrative courts of contractual appeals have been marking in their resolutions regarding the qualitative and quantitative dimension of the award criteria. El presente estudio se ha realizado en el marco del proyecto de investigación titulado «La efectiva implantación de la responsabilidad social en las Administraciones Públicas», financiado por la Universidad de Alicante, en la Convocatoria del programa propio del Vicerrectorado de Investigación y Transferencia de Conocimiento para el fomento de la I+D+I de 2019 (Referencia: (GRE19-03), y cuyo investigador principal es José Miguel Beltrán Castellanos.
