Alors que les installations disposent de l'ensemble des autorisations administratives requises, leurs plans d'approvisionnements sont contestés localement. Cette contribution propose d'évaluer les possibilités offertes par le droit pour répondre à ces dysfonctionnements et présente une réflexion sur le niveau pertinent d'intégration de critères réglementaires de durabilité. Sont alors envisagées différentes législations sectorielles pouvant accueillir de tels critères. Il n'est pourtant pas sûr que les garanties territoriales soient les objectifs prioritaires, les objectifs carbone répondant à des enjeux juridiquement supérieurs. Implementing the politics of support of electricity production from biomass casts doubt upon the renewable aspect of this energy source, especially in the Mediterranean region. While the recent regional plants have gathered the required administrative authorisations, their supplies plans are locally disputed. This paper offers to estimate the possibility for Law to answer these dysfunctions. It presents a reflexion on the relevant level of integration of sustainable statutory criteria. Various sectorial legislations are then envisaged to welcome such criteria. Nevertheless, territorial guarantees seems not to be the priority objectives, the carbon ones are actually answering stakes that are defined in supra-national law.

Elles montrent une structuration spatiale des pluies intenses autour des principaux reliefs et des différents sous bassins qui composent la Méditerranée. Les pluies intenses sont associées à des dépressions localisées. La dynamique atmosphérique large-échelle explique en partie la formation de ces forçages locaux des pluies intenses. En effet, la fréquence des régimes de circulation atmosphérique « Greenland Above » (« Atlantic Ridge ») explique en partie l’occurrence des pluies intense dans le golfe du Lion et l’Adriatique (autour de la mer Égée). Le changement climatique ne devrait pas modifier la fréquence de ces deux régimes de circulation. En revanche, des changements dans leur configuration barométrique moyenne devraient renforcer leur relation respective avec les pluies intenses en Méditerranée. En d’autres termes, la fréquence des pluies intenses en Méditerranée ne devrait pas devenir plus importante au cours du xxie siècle, mais lorsque les événements se produiront durant ces deux régimes de circulation, ils devraient être de plus en plus intenses. Eight wintertime extreme rainfall patterns have been computed over the whole Mediterranean basin. Extreme rainfalls are typically organized around the main sub-basin and are linked with orographic characteristics. Local atmospheric forcing of extreme rainfalls is mainly characterized by intra-Mediterranean cyclogenesis. Nevertheless, large-scale atmospheric circulation can partly explain the occurrence of some Mediterranean extreme rainfall events. For example, the frequency of “Greenland above” (“Atlantic Ridge”) weather regime explains parts of the occurrence of extreme rainfall events in the Gulf of Lions and in the Adriatic Sea (around Egerian Sea). Climate change would not change the wintertime frequency of these two weather regimes. Nevertheless, changes in mean barometric conditions within these weather regimes would increase the relationship with extreme rainfalls in the Mediterranean basin. In other words, extreme rainfalls would not become more frequent in the 21st century but events that would occurred during “Greenland above” and “Atlantic Ridge” weather regimes could become more intense.

Le bassin de Saint-Étienne, l’un des plus importants, est aussi celui qui recense le plus de victimes, avec des morts qui se comptent, chaque année, à plusieurs dizaines voire plusieurs centaines d’ouvriers. Face à la répétition de ces drames, les compagnies minières impliquées se montrent frileuses au moment de mettre en œuvre les solutions techniques et organisationnelles qui permettraient de réduire les risques. C’est pourquoi l’État, par le biais de l’administration des Mines, soutenue par les autorités préfectorales, se lance dans la constitution d’une nouvelle forme de régulation de l’activité industrielle, beaucoup moins portée vers le laisser-faire et qui, au contraire, vise à constituer un corpus réglementaire dense et à en contrôler fermement l’application. À Saint-Étienne, les résultats obtenus par les ingénieurs des Mines, sont particulièrement encourageants. Après 1893 et pendant près de vingt ans, les catastrophes disparaissent. In the 1880s, French coal mines were regularly hit by firedamp disasters. The Saint-Étienne coalfield, one of the largest, was also the one that claimed the most victims, with dozens, even hundreds of workers dying every year. Faced with these repeated tragedies, the mining companies concerned were reluctant to implement the technical and organizational solutions that would reduce the risks. That's why the State, through the mining administration, supported by the prefectural authorities, has set out to create a new form of regulation for industrial activity, one that is not laissez-faire but, on the contrary, aims to build up a dense body of regulations and firmly control their application. In Saint-Étienne, the results achieved by the mining engineers were particularly encouraging. After 1893 and for almost twenty years, the number of claims disappeared.

Ce projet a pour objectif, entre autres, d’identifier et de décrire des itinéraires de randonnée toponymique dans le territoire de la Basse Vallée d’Aoste. Environ un an après le début du travail, j’ai jugé intéressant de vérifier dans quelle mesure les types toponymiques mis en évidence dans chaque itinéraire sont représentatifs de l’ensemble du territoire de la Basse Vallée. Il en résulte une collection de types toponymiques ordonnés en fonction des différents domaines culturels auxquels ils se réfèrent : la culture de la châtaigne, de la vigne et du chanvre, l’irrigation des champs et des prés, l’exploitation minière, la production de charbon, la présence de forêts interdites et de terrains domaniaux où la récolte du foin sauvage était autorisée. Cette collection permet donc de faire quelques considérations sur la diffusion des différents types toponymiques sur le territoire des 17 communes participant au projet, ainsi que de mettre en évidence l’utilité de la toponymie pour raconter le paysage culturel d’une région. This contribution stems from the DE-TOURS project, the Aosta Valley branch of the wider project PNRR NODES – Nord Ovest Digitale e Sostenibile. Among other initiatives, this project aims to identify and describe toponymic hiking itineraries in the Lower Aosta Valley. About a year after starting work on the project, I thought it would be interesting to see to what extent the toponymic types highlighted in each itinerary are representative of the Lower Valley as a whole. The result is a collection of toponymic types arranged according to the different cultural domains to which they refer: the cultivation of chestnuts, vines and hemp, the irrigation of fields and meadows, mining, coal production, the presence of forbidden forests and state-owned land where the harvesting of wild hay was permitted. This collection therefore allows us to make some observations about the spread of different toponymic types over the territory of the 17 communes participating in the project, as well as to highlight the usefulness of toponymy in telling the story of a region’s cultural landscape.

The ecological association Natuurpunt responsible for this postponement was subsequently asked to join the governance process. For its part, the Doel 2020 Action Committee adopted a cultural approach to the polders and villages under threat. Whereas this vision – more in line with current socioeconomic issues – should have curried favour in the eyes of the port authorities, it was Natuurpunt which was instead designated as the unique contact partner. Relying on the systemic modelling of nature, the latter played an active role in establishing a political compromise. This reductionism nevertheless prevented it from discussing the validity of the objectives pursued in terms of their general interest and contributed to the “ordering” of people by eliminating the cultural and, consequently, the social dimension.

Cette recrudescence, observée depuis 1973 dans tout le Sahel, ne devrait pas cependant nous faire oublier que les premières études qui mentionnent ces types de temps remontent aux années cinquante (Dubief, 1951) et que ces phénomènes représentent une composante du climat régional, que les récentes sécheresses ont exacerbé. Since the great Sahelian droughts of the 70’s, the increase in the occurrence of weather types associated with dust and sand (litho meteors) displacement aroused an increasing scientific interest. However, the first studies about these weather types have been published since the 50’s (Dubief, 1951). The weather types with litho meteor displacement are a component of the regional climate, and their importance grew during the recent droughts.

Face à ce contexte, la certification environnementale de divers produits issus de l’usage des terres agricoles et forestières augmente. Cet article analyse et compare les cas du bois issu de l’exploitation communautaire en Amazonie et du café bio. La mise en place de ces certifications est-elle à même de concilier efficacité économique, équité sociale et durabilité environnementale ? La comparaison entre ces deux cas vise à mettre en lumière les impacts positifs et négatifs des diverses institutions qui interagissent dans ces processus. In Brazil, there are growing environmental concerns because of the negative impacts of a rapid agricultural growth on natural resources and environment. In this context, environmental certification of several agricultural and forest products is increasing. This paper analyzes and compares the cases of timber production based on community management in the Amazon and of organic coffee. Do theses processes of certification allow to reconcile economic effectiveness, social equity and environmental sustainability? The comparison aims at clarifying the positive and negative impacts of the various institutions interacting in these processes.

Alors que les installations disposent de l'ensemble des autorisations administratives requises, leurs plans d'approvisionnements sont contestés localement. Cette contribution propose d'évaluer les possibilités offertes par le droit pour répondre à ces dysfonctionnements et présente une réflexion sur le niveau pertinent d'intégration de critères réglementaires de durabilité. Sont alors envisagées différentes législations sectorielles pouvant accueillir de tels critères. Il n'est pourtant pas sûr que les garanties territoriales soient les objectifs prioritaires, les objectifs carbone répondant à des enjeux juridiquement supérieurs. Implementing the politics of support of electricity production from biomass casts doubt upon the renewable aspect of this energy source, especially in the Mediterranean region. While the recent regional plants have gathered the required administrative authorisations, their supplies plans are locally disputed. This paper offers to estimate the possibility for Law to answer these dysfunctions. It presents a reflexion on the relevant level of integration of sustainable statutory criteria. Various sectorial legislations are then envisaged to welcome such criteria. Nevertheless, territorial guarantees seems not to be the priority objectives, the carbon ones are actually answering stakes that are defined in supra-national law.

Elles montrent une structuration spatiale des pluies intenses autour des principaux reliefs et des différents sous bassins qui composent la Méditerranée. Les pluies intenses sont associées à des dépressions localisées. La dynamique atmosphérique large-échelle explique en partie la formation de ces forçages locaux des pluies intenses. En effet, la fréquence des régimes de circulation atmosphérique « Greenland Above » (« Atlantic Ridge ») explique en partie l’occurrence des pluies intense dans le golfe du Lion et l’Adriatique (autour de la mer Égée). Le changement climatique ne devrait pas modifier la fréquence de ces deux régimes de circulation. En revanche, des changements dans leur configuration barométrique moyenne devraient renforcer leur relation respective avec les pluies intenses en Méditerranée. En d’autres termes, la fréquence des pluies intenses en Méditerranée ne devrait pas devenir plus importante au cours du xxie siècle, mais lorsque les événements se produiront durant ces deux régimes de circulation, ils devraient être de plus en plus intenses. Eight wintertime extreme rainfall patterns have been computed over the whole Mediterranean basin. Extreme rainfalls are typically organized around the main sub-basin and are linked with orographic characteristics. Local atmospheric forcing of extreme rainfalls is mainly characterized by intra-Mediterranean cyclogenesis. Nevertheless, large-scale atmospheric circulation can partly explain the occurrence of some Mediterranean extreme rainfall events. For example, the frequency of “Greenland above” (“Atlantic Ridge”) weather regime explains parts of the occurrence of extreme rainfall events in the Gulf of Lions and in the Adriatic Sea (around Egerian Sea). Climate change would not change the wintertime frequency of these two weather regimes. Nevertheless, changes in mean barometric conditions within these weather regimes would increase the relationship with extreme rainfalls in the Mediterranean basin. In other words, extreme rainfalls would not become more frequent in the 21st century but events that would occurred during “Greenland above” and “Atlantic Ridge” weather regimes could become more intense.

Le bassin de Saint-Étienne, l’un des plus importants, est aussi celui qui recense le plus de victimes, avec des morts qui se comptent, chaque année, à plusieurs dizaines voire plusieurs centaines d’ouvriers. Face à la répétition de ces drames, les compagnies minières impliquées se montrent frileuses au moment de mettre en œuvre les solutions techniques et organisationnelles qui permettraient de réduire les risques. C’est pourquoi l’État, par le biais de l’administration des Mines, soutenue par les autorités préfectorales, se lance dans la constitution d’une nouvelle forme de régulation de l’activité industrielle, beaucoup moins portée vers le laisser-faire et qui, au contraire, vise à constituer un corpus réglementaire dense et à en contrôler fermement l’application. À Saint-Étienne, les résultats obtenus par les ingénieurs des Mines, sont particulièrement encourageants. Après 1893 et pendant près de vingt ans, les catastrophes disparaissent. In the 1880s, French coal mines were regularly hit by firedamp disasters. The Saint-Étienne coalfield, one of the largest, was also the one that claimed the most victims, with dozens, even hundreds of workers dying every year. Faced with these repeated tragedies, the mining companies concerned were reluctant to implement the technical and organizational solutions that would reduce the risks. That's why the State, through the mining administration, supported by the prefectural authorities, has set out to create a new form of regulation for industrial activity, one that is not laissez-faire but, on the contrary, aims to build up a dense body of regulations and firmly control their application. In Saint-Étienne, the results achieved by the mining engineers were particularly encouraging. After 1893 and for almost twenty years, the number of claims disappeared.

Ce projet a pour objectif, entre autres, d’identifier et de décrire des itinéraires de randonnée toponymique dans le territoire de la Basse Vallée d’Aoste. Environ un an après le début du travail, j’ai jugé intéressant de vérifier dans quelle mesure les types toponymiques mis en évidence dans chaque itinéraire sont représentatifs de l’ensemble du territoire de la Basse Vallée. Il en résulte une collection de types toponymiques ordonnés en fonction des différents domaines culturels auxquels ils se réfèrent : la culture de la châtaigne, de la vigne et du chanvre, l’irrigation des champs et des prés, l’exploitation minière, la production de charbon, la présence de forêts interdites et de terrains domaniaux où la récolte du foin sauvage était autorisée. Cette collection permet donc de faire quelques considérations sur la diffusion des différents types toponymiques sur le territoire des 17 communes participant au projet, ainsi que de mettre en évidence l’utilité de la toponymie pour raconter le paysage culturel d’une région. This contribution stems from the DE-TOURS project, the Aosta Valley branch of the wider project PNRR NODES – Nord Ovest Digitale e Sostenibile. Among other initiatives, this project aims to identify and describe toponymic hiking itineraries in the Lower Aosta Valley. About a year after starting work on the project, I thought it would be interesting to see to what extent the toponymic types highlighted in each itinerary are representative of the Lower Valley as a whole. The result is a collection of toponymic types arranged according to the different cultural domains to which they refer: the cultivation of chestnuts, vines and hemp, the irrigation of fields and meadows, mining, coal production, the presence of forbidden forests and state-owned land where the harvesting of wild hay was permitted. This collection therefore allows us to make some observations about the spread of different toponymic types over the territory of the 17 communes participating in the project, as well as to highlight the usefulness of toponymy in telling the story of a region’s cultural landscape.

The ecological association Natuurpunt responsible for this postponement was subsequently asked to join the governance process. For its part, the Doel 2020 Action Committee adopted a cultural approach to the polders and villages under threat. Whereas this vision – more in line with current socioeconomic issues – should have curried favour in the eyes of the port authorities, it was Natuurpunt which was instead designated as the unique contact partner. Relying on the systemic modelling of nature, the latter played an active role in establishing a political compromise. This reductionism nevertheless prevented it from discussing the validity of the objectives pursued in terms of their general interest and contributed to the “ordering” of people by eliminating the cultural and, consequently, the social dimension.

Since the great Sahelian droughts of the 70’s, the increase in the occurrence of weather types associated with dust and sand (litho meteors) displacement aroused an increasing scientific interest. However, the first studies about these weather types have been published since the 50’s (Dubief, 1951). The weather types with litho meteor displacement are a component of the regional climate, and their importance grew during the recent droughts.

Face à ce contexte, la certification environnementale de divers produits issus de l’usage des terres agricoles et forestières augmente. Cet article analyse et compare les cas du bois issu de l’exploitation communautaire en Amazonie et du café bio. La mise en place de ces certifications est-elle à même de concilier efficacité économique, équité sociale et durabilité environnementale ? La comparaison entre ces deux cas vise à mettre en lumière les impacts positifs et négatifs des diverses institutions qui interagissent dans ces processus. In Brazil, there are growing environmental concerns because of the negative impacts of a rapid agricultural growth on natural resources and environment. In this context, environmental certification of several agricultural and forest products is increasing. This paper analyzes and compares the cases of timber production based on community management in the Amazon and of organic coffee. Do theses processes of certification allow to reconcile economic effectiveness, social equity and environmental sustainability? The comparison aims at clarifying the positive and negative impacts of the various institutions interacting in these processes.

When modern society ceases to acknowledge the transcendental source of its legitimacy, it tends to substitute its own values and to impose them upon local populations by way of ethical and legal frameworks. Within the context of ongoing debates on climate warming, it is becoming more and more evident that Ecology and Law are acquiring a transcendental nature and that the policies they foster are giving rise to local resistance, thus creating the issue of a “cosmopolitical shock.”
