Description

The project TRUST_ISSUES focuses on a particular case of "legal transfer", through the example of the creation, inspired by Community Land Trusts (CLT), of the French Organismes de Foncier Solidaire (OFS). A first part of the project deals with the way this transfer can be viewed as a case of legal "interaction" between two different legal-political systems. The project members will observe and evaluate the legal innovations produced by this "interaction", as well as their applications on the ground. In order to understand these applications, it is necessary to understand the interactions between both private and public actors, at different levels. The project will help understanding these complex dynamics, from the creation to the implementation of the OFS. Part of the project will consist in the use of a "complex systems" framework in order to reframe the concept of "transfer" as an "interaction". The comparative part of the project will, in the meantime, endeavor to analyze how different institutional ecosystems have considered or are considering importing CLTs in their own system. A second part of the project, of a more normative nature, will use the tools of legal theory (applied to property rights) and the social sciences to determine the place of CLT and OFS have in a broader philosophy of housing, from the point of view of social and economic justice. Using knowledge and data from social sciences, this theoretical and philosophical approach will strive to understand how, in the name of socio-economic justice, diverging individual as well as institutional interests can come together for a fair housing policy. This perspective goes beyond the public/private divide, since it is interested in the many forms a housing policy can take, as it interacts with the market. TRUST_ISSUES thus gathers legal scholars, economists and philosophers to develop a common conceptual framework to comprehend these issues.
