Windkraftanlagen im Spannungsverhältnis zwischen Naturschutz und erneuerbaren Energien in Natura 2000 Gebieten

Abstract

Windkraftanlagen haben gerade in den letzten Jahren enorm an Bedeutung gewonnen, wenn es um Umweltschutz bzw. die Errichtung von erneuerbaren Energieträger geht. Die vorliegende Arbeit stellt die wichtigsten rechtlichen Grundlagen im Zusammenhang mit der Errichtung von Windkraftanlagen dar, sowie die zu beachtenden Vorgaben der Natura 2000 Gebiete, als auch die Rolle von Nachbarn und Bürgerinitiativen in solch einen Verfahren. Im ersten und zweiten Teil der Arbeit werden sowohl die Vorgaben des Umweltverträglichkeitsprüfungsgesetzes 2000, als auch die landesrechtlichen Vorschriften der Steiermark näher erläutert. Im dritten Teil liegt der Fokus auf den europarechtlichen Vorgaben für Natura 2000 Gebiete, vor allem erfolgt eine genaue Betrachtung der Vogelschutz- und FFH-Richtlinie. Zu guter Letzt werden Möglichkeiten aufgezeigt, die Nachbarn im Falle einer Windkraftanlagenerrichtung haben, sowie die Bürgerinitiative näher beleuchtet. ; In the last few years, wind turbines have grown enormously in importance when it comes to environmental protection and the construction of renewable energy sources. The present thesis presents the most important legal foundations in connection with the construction of wind power plants, as well as the requirements of the Natura 2000 areas, as well as the role of neighbors and citizens’’ initiatives in such a procedure. In the first and second part of the thesis, the requirements of the Environmental Impact Assessment Act 2000 as well as the regulations of the state of Styria are explained in more detail. In the third part, the focus is on the European guidelines for Natura 2000 areas, in particular, a detailed examination of the Birds and Habitats Directive. Last but not least the possibilities of neighbors in case of a wind turbine installation are presented, as well as more detailed information concerning the citizens’ initiative. ; eingereicht von: Jasmine Glaser, Bsc. ; Diplomarbeit Universität Linz 2017
