Zur zukünftigen Regulierungspolitik für die deutsche Stromwirtschaft

Abstract

In diesem Papier werden die in Kumkar (1999) gewonnene Erkenntnisse hinsichtlich der komparativen Vorteile alternativer Liberalisierungsmodell für die Stromwirtschaft auf die deutsche Situation übertragen. Ziel ist die Erarbeitung von Empfehlungen für die weitere wettbewerbliche Neuordnung der Stromwirtschaft. Zu fragen ist somit zum einen nach der inhaltlichen Ausrichtung der Regulierung, ob also das Alleinabnehmermodell, das Modell spezifischer Durchleitungsrechte, das Poolmodell oder aber das Common-Carrier-Modell Richtschnur der Regulierung sein sollte. Zum anderen wird nach der institutionellen Ausgestaltung der Regulierung gefragt. Im Rahmen dieser Diskussion wird den jüngsten rechtlichen Entwicklungen auf europäischer und auf deutscher Ebene explizit Rechnung getragen. Es wird auch die Frage behandelt, ob und gegebenenfalls welche Änderungen an der vor einem Jahr in Kraft getretenen Energierechtsnovelle notwendig sind. This paper applies the insights yielded in Kumkar (1999) on the comparative advantages of alternative liberalization models for the electricity industry. The aim is to develop guidelines on the further opening of Germany's electricity market. The paper provides an answer to the question, whether the single buyer model, the wheeling model, the pool model, or the common carrier model should be implemented. In addition, the paper discusses questions concerning the appropriate institutional design of the regulation. Within this context, the recent legal developments on the European and the German level are explicitly taken into consideration. The paper discusses the new German electricity law, and develops several measures to improve on the current design of regulation.
