Abstract

ilustraciones, gráficas, tablas El presente trabajo se enfoca en realizar una lectura del proceso de Restitución de Tierras desde la herramienta administrativa de Evaluación Ambiental Estratégica (EAE), con el objetivo de abrir la posibilidad de integrar criterios ambientales en la toma de decisiones y, a su vez, articular el desarrollo sostenible desde los niveles más altos del quehacer político. Esto en perspectiva de aportar nuevos elementos de análisis que contribuyan a una justicia transicional reparadora y transformadora. En los últimos años, el país ha iniciado un periodo de cambio con miras a la construcción de paz y, en ese marco, es necesario abrir debates que involucren diversas perspectivas a las políticas de justicia transicional, si el objetivo común es lograr una paz duradera y la reconciliación nacional. El acercamiento de esta herramienta al proceso de restitución de tierras se realiza a partir de un análisis sobre la EAE y el modelo general propuesto por Oñate et al. (2002). Posteriormente, retomando la fase preliminar de la EAE expuesta, se inicia presentando la organización de la lectura mediante tres componentes: uno, análisis del proceso de restitución de tierras y sus avances; dos, identificación de fuentes de impactos ambientales que incluyen aspectos como la trasformación de la producción agropecuaria, minería y etapa pos fallo; y tres, la propuesta metodológica para aportar a la reparación transformadora. En la última fase se concreta el aporte central de la lectura propuesta, el cual es el Índice de Condiciones de Favorabilidad Ambiental para la Restitución (ICFAR), el cual utiliza un sistema de ponderación de favorabilidad para la restitución que conjugan factores sociales y ambientales que aporta a la lectura de las condiciones de los territorios y puede ser de insumo para la toma de decisiones respecto a la restitución. Al finalizar, se exponen algunos de los retos, potencialidades y recomendaciones en la ampliación de la lectura, la implementación de la ICFAR y la utilización de la EAE como herramienta para la formulación de planes, política y proyectos. (Texto tomado de la fuente) The present work focuses on reading the process of restoration of the tools of the Strategic Environmental Assessment (SEA), with the objective of opening the possibility of integrating environmental criteria into decision making and, in turn, articulating sustainable development from the highest levels of political activity. This in perspective of new elements of analysis that contribute to transitional justice restorative and transforming. In recent years, the country has begun a period of change for peace-building and, in that context, it is necessary to open debates that involve different perspectives on transitional justice policies. The common goal is to achieve lasting peace and national reconciliation. The approach of this tool to the land restitution process is based on an EAE analysis and the general model proposed by Oñate et al. (2002). Subsequently, resuming the preliminary phase of the exposed EAE, begins the organization of reading by three components: one, analysis of the land restitution process and its progress; two, identification of sources of environmental impacts that include aspects such as the transformation of agricultural production, mining and post-failure; and three, the methodological proposal to contribute to the transformative repair. In the last phase the central contribution of the proposed evaluation, which is the Index of Environmental Favorability for Restitution (ICFAR), is used, which uses a favorability weighting system for restitution that combines social and environmental factors which contributes to the reading of the conditions of the territories and may be insufficient to make decisions regarding restitution.
