Nel contributo si intende offrire una riflessione sulla legge cost. n. 1 del 2022 che ha segnato l’ingresso della “tutela dell’ambiente” nella Costituzione italiana. L’A. dubita che la riforma abbia una funzione esclusivamente simbolica ed evidenzia il risalto della componente di doverosità nella relazione tra essere umano e ambiente che in essa pare cogliersi, la quale, per di più, parrebbe rafforzata dall’emersione dell’ “interesse delle future generazioni”, legato, a sua volta, al principio di sostenibilità ambientale. Infine, il saggio si focalizza sulle ricadute che, in relazione al riparto di competenze legislative tra Stato e Regioni, potrebbero derivare dall’attribuzione al primo del compito di tutela degli animali.

The Essay discusses the effects of the Constitutional Law n. 1/2022, that provides protection to environment in the Italian Constitution. The Author doubts that the reform has only a nominal role and highlightes that it seems to emphasize the duty in the relationship between human beings and the environment. Moreover, in the same direction is the provision of the “interest of future generations”, that is connected to the principle of environmental sustainability. Finally, the Article focuses on the rebounds that, in the division of legislative powers between State and Regions, could arise from the new statal competence relating to animal protection.
