Racionalidade comunicativa e ambiental: a licitação pública do município de Teresina é instrumento de desenvolvimento sustentável?

Abstract

RESUMÉ Ce travail est inséré dans la ligne de la recherche des droits sociaux, de la réglementation économique et du développement et est basé sur l'obligation constitutionnelle de promouvoir le développement national, et principalement dans la modification législative imposée par la loi nº 12.349/ 2010, qui a commencé à exiger plus du pouvoir public en termes de durabilité - comme c'est la nécessité de parvenir à des appels d'offres durables afin de promouvoir le développement. L'objectif de cette étude était d'analyser la discursivité du processus d'appel d'offres pour discuter la rationalité environnementale (communicative) qui fait avancer le processus susmentionné. Afin d'obtenir les résultats souhaités, une enquête empirique a été menée dans le cadre des procédures d'appel d'offres effectuées par la ville de Teresina-PI, qui ont eu lieu en 2018, afin d'analyser les questions contenues dans l'appel d'offres et ses spécifications, qui exigent expressément un tel désiderate, en plus de mener une entrevue avec les membres du comité d'appel d'offres. A partir de là, considérant qu'il n'y a pas de conscience environnementale de la protection de l'environnement, la rationalité environnementale a été discutée selon Leff (2002; 2006), qui est vérifiée par le déplacement épistémique d'une centralité anthropocentrique pour biocentric, dans les discours de documents et de sujets de gestion publique, pris comme rationalité communicative, dans la vision de Habermas (2016), parce qu'il considère que la langue est l'expression des consensus, bien que précaires, existant dans une société, Par conséquent, c'est l'empyrie qui révèle la conscience environnementale. Dans ce fil de conducteur établi, le problème de recherche a été analysé : l'appel d'offres public de la ville de Teresina est-il un instrument de développement durable ? Par conséquent, le diagnostic suivant a été atteint: la durabilité n'est pas incluse dans les offres et ce fait est dû à l'absence de sensibilisation à l'environnement, comme celle abordée par Enrique Leff, compte tenu, encore, le manque de rationalité communicative selon Habermas, suggérant que la raison qui guide nos actions ne compte pas sur des compréhensions environnementales raisonnables, compte tenu de l'orientation anthropocentrique de la logique de la modernité qui produit l'effet d'une rationalité communicative de la protection non-environnementale.

Este trabalho está inserido na linha de pesquisa Direitos Sociais, Regulação Econômica e Desenvolvimento, e fundamenta-se no dever constitucional de promoção do desenvolvimento nacional, e, principalmente, na alteração legislativa imposta pela Lei nº 12.349/2010, que passou a exigir mais do poder público em matéria de sustentabilidade – como se verifica na exigência de realizações de licitações sustentáveis com vistas à promoção do desenvolvimento. Objetivou-se, assim, analisar a discursividade do processo das licitações para discorrer sobre a racionalidade (comunicativa) ambiental que move o referido processo. Para alcançar os resultados pretendidos, procedeu-se a uma investigação empírica nos procedimentos licitatórios realizados pela Prefeitura de Teresina-PI, ocorridos no ano de 2018, para fins de analisar aspectos constantes no edital e suas especificações, que demandem concretamente tal desiderato, além da realização de entrevista com os membros da comissão de licitação. A partir daí, tendo-se como pressuposto, inclusive, que não existe consciência ambiental de proteção ao meio ambiente, discutiu-se racionalidade ambiental segundo Leff (2002; 2006), que se verifica pelo deslocamento epistêmico de uma centralidade antropocêntrica para biocêntrica, nos discursos dos documentos e dos sujeitos da gestão pública, tomados como racionalidade comunicativa, na visão de Habermas (2016), por considerar que a linguagem é a expressão dos consensos, ainda que precários, existentes numa sociedade, tratando-se, portanto, da empiria que revela a consciência ambiental. Dentro deste fio condutor estabelecido, fez-se a análise do problema de pesquisa: a licitação pública do município de Teresina é instrumento de desenvolvimento sustentável? Chegou-se, pois, ao seguinte diagnóstico: a sustentabilidade não está inserida nas licitações e tal fato se dá por ausência de consciência ambiental, como a tratada por Enrique Leff, considerando, ainda, a falta de racionalidade comunicativa segundo Jünger Habermas, o que sugere que a razão que orienta as ações não conta com entendimentos ambientais razoáveis, haja vista a orientação antropocêntrica da lógica da modernidade que produz o efeito de uma racionalidade comunicativa de não proteção ambiental.

This work is part of the Social Rights, Economic Regulation and Development reaserch line and is based on the constitutional duty to promote national development, and especially the legislative amendment imposed by Law no. 12.349 / 2010, which started to demand more from the public power in the area of sustainability - as verified in the requirement of holding sustainable bids with a view to promoting development. Thus, the objective was to analyze the discursiveness of the bidding process to discuss the environmental (communicative) rationality that drives the referred process. In order to achieve the desired results, an empirical investigation was carried out into the bidding procedures carried out at the Teresina-PI Prefecture, which took place in 2018, in order to analyze the aspects contained in the notice and its specifications that specifically demand such desiderate, in addition to the dialogue established with the members of the bidding committee. From that point, even assuming that there was no environmental awareness of environmental protection, the environmental rationality was discussed according to Enrique Leff (2002; 2006), which is verified by the epistemic shift from an anthropocentric to a biocentric centrality, in the discourses of the documents and of the subjects of public management taken as communicative rationality with Habermas (2016), considering that language is the expression of the consensus, however precarious, that exists in a society, being, therefore, the empiric that reveals the environmental conscience. Within this established thread, the research problem was analyzed: is the public bidding of the Municipality of Teresina an instrument of sustainable development? Thus, the following diagnosis was reached: that sustainability is not included in the bids and this is due to the lack of environmental awareness as addressed by Enrique Leff, considering also the lack of communicative rationality according to Jürgen Habermas, which suggests that the reason that guides our actions does not have reasonable environmental understandings, given the anthropocentric orientation of the logic of modernity that produces the effect of a communicative rationality of non-environmental protection.
